1. Acceptance of Terms

By accessing ateliertati.design (“the Website”), you agree to be bound by these Terms and Conditions. Atelier Tati provides professional website design and brand identity services for small businesses and independent brands across a range of industries.

2. Service Scope: Website Design & Development

Our “Professional Website Redesign” service involves structured planning, custom design, and technical implementation.

  • Planning vs. Execution: We prioritize thorough planning and a clear understanding of your business needs before technical work begins, to ensure a well-structured outcome.
  • Documentation & Transparency: We provide process documentation and work records throughout the project to maintain professional transparency, rather than making exaggerated marketing promises.

3. Intellectual Property & Code Ownership

  • Custom Frameworks: Atelier Tati retains ownership of proprietary design frameworks, templates, and internal tools used during the build process.
  • Client Ownership: Upon full payment, the client receives full ownership of the final website, including all custom components created for the project.

4. Professional Transparency

We do not guarantee specific search engine ranking results. We provide thoughtful, well-structured design work intended to improve the clarity, professionalism, and usability of your online presence.

5. Client Responsibilities

The client must provide necessary documentation, content, and timely feedback to keep the project on track. Delays caused by a lack of client feedback, missing materials, or issues within the client’s existing legacy systems are not the responsibility of Atelier Tati.

6. Limitation of Liability

Atelier Tati is not liable for performance issues arising from the client’s choice to retain outdated plugins or existing infrastructure against our professional recommendations regarding site performance and optimization.

7. Professional Fees & Payment Structure

Atelier Tati operates on a project-based milestone system to ensure clear structure and transparency at every stage.

  • Direct Engagements: Unless otherwise agreed in a specific Statement of Work (SOW), projects require a 50% non-refundable deposit to commence work, covering initial discovery and planning. The remaining balance is due upon final project handover.
  • Upwork Engagements: For clients engaged via the Upwork platform, all payments, escrowed funds, and milestones are governed strictly by Upwork’s Terms of Service and Dispute Resolution protocols.

8. Cancellation & Refund Policy

Because our services involve custom design work and time-intensive development, our refund policy is as follows:

  • Discovery & Planning Phase: Once the initial research and planning phase has begun, the initial deposit is non-refundable.
  • Post-Deployment: No refunds will be issued once the final website files have been delivered or the site has gone live.
  • Unearned Fees: In the unlikely event that Atelier Tati must terminate an agreement for convenience (without cause), any fees for milestones not yet started will be refunded to the client within 30 days.

9. Governing Law & Dispute Resolution

These terms are governed by the laws of Taiwan (R.O.C.).

  • Amicable Resolution: In the event of a dispute, both parties agree to first attempt to resolve the matter through direct, good-faith communication for a period of 30 days.
  • Jurisdiction: Any unresolved legal disputes shall be subject to the exclusive jurisdiction of the courts in Taipei City.
